We're looking for webcasters and musicians who might be willing to come to Washington, DC, on April 30th (starting at 3PM) through May 1st (through 6PM) to participate in a "Hill walk" — being part of one of several small teams of people that will each visit six or seven Congressional offices that day and tell our story. Headline: "'Day of Silence' plans coming together with your support"

Plans for the upcoming "Day of Silence" are coalescing, and a framework for the event is coming together, as support and suggestions from day of silencewebcasters continue to pour in to our offices.

As mentioned previously in RAIN [here], the primary goal is to design a "media event" that gets press — specifically, press that will have a direct impact on Congressmen. The goal of a "Day of Silence" is not primarily to get listeners calling their Congressmen, although we think it will also do that.

With that in mind, here's a look at the plans so far:

  • We believe that the ideal date for this particular event is Tuesday, May 8th — exactly one week before many of us may need to go silent permanently. Also, by that date a bill will hopefully already have co-sponsors, might have a committee hearing, and could be coming up to a vote soon.
  • Per the suggestion of some webcasters, we considered re-naming the event "The Day The Music Died."(It might be problematic to use it for May 8th if the music comes back to life on May 9th) However, we're already using that name for D-Day, May 15th — which will be the day the music dies, permanently, if Congress doesn't step in.
  • "Day of Silence" is a nice, catchy, four-syllable name that resonates. SilenceIt works well in headlines. Some journalists (and consumers) remember the same event five years ago and we can build on those memories.
  • The idea of a day of all non-RIAA music has also been suggested. The problem with that idea is that many listeners might respond, "Fine! Problem solved! Just do that permanently!" and for most webcasters, given their genre choices and target audiences, that is not technically practical. [As a reference, a list of RIAA-member labels is here.]
  • We have floated the idea of, on that day, organizing a nationwide talk show hosted by some combination of NPR stations and/or Wolf FM. To really live up to the name "Day of Silence", however, we concluded that this time we really need silence. (Too many journalists last time started going down the path of "You're calling it a Day of Silence, but you're not really silent...?" We don't want to risk that again.)
  • For those webcasters who have advertising commitments to fulfill, we believe a Tuesday will work well. Hopefully the event gets so much press coverage that some of the hours of listening you lose on Tuesday you may be able to make up on Wednesday through Friday.
  • Last time, five years ago, we did not have the participation of the major Internet-only players. This year, we already have commitments RAIN Day of Silence 2002 Issue from major webcasters. We're also reaching out to large broadcasters (i.e., Clear Channel, CBS, Entercom, Bonneville, Cox, et al.) to gauge their interest in participation.
  • We will work out a system where you can commit to your support and participation. We should all work together to develop personalized banner or player ads explaining the situation and encouraging action from listeners — "While we're silent today, we hope you'll use this time to call your Senators and Representative, so we don't have to go silent permanently a week from today..."

In planning the "Day of Silence", we've incorporated feedback from webcasters and listeners to make as successful of a "community effort" as possible. Use our feedback form to commit your station and volunteer additional suggestions.

Let's do it! You have our support! 525.com Power Tracks will join the May 8th Day of Silence and urge this to be a global effort, as well. I think it would be a great idea to get a list of stations going that plan to join the Day of Silence to sort of put the pressure on other stations who may be indecisive about shutting down for the day.

This is a great idea, both our stations (WCH Radio and The Wave) will support it. We also run two podcasts from our MySpace pages and our websites. We could run all the PSAs only on that day on our podcasts also.
I'll be on the hill with you (again) and you can count on 1Club.fm and WBMX.com being SILENT on that day with just one thing running... OUR PSA pointing the listeners to contact their Congress persons or else this (insert silence) is all you're going to hear after next week on your favorite Internet radio stations.

Day of Silence? I'm in. Although small by comparison to many other 'net-caters, Pagan Radio Network has a loyal listenership.
I like the idea of total silence... we need the biggest impact possible. Puregold Rock 'N Roll would love to help in any way. I also think each station should notify their local press with a release as to the total black-out of Internet radio.
I'm all for a day of silence...as they say, absence makes the heart grow fonder. I have invested a lot of passion and energy into Devil Free Radio and will go down swinging!

From The Hollywood Reporter: "In one of CBS Radio's first major moves in the technology space since Dan Mason recently took over as president and targetspotCEO, the CBS Corp. unit said Tuesday that it has incubated and become an investor in TargetSpot Inc., a provider of advertising serving technology for advertisers and Internet broadcasters...

"The company's technology allows businesses and individuals to create, buy and place their own advertising messages within streaming media using an array of jingles, sound effects and visuals provided by TargetSpot. Ads are then targeted to specific cbs radiodemographics, locations or properties, with the revenue being shared between TargetSpot and its respective broadcast partner...

"CBS Radio said it will utilize the firm's technology on its more than 100 music, talk, sports and news radio stations broadcasting live via the Internet.

"Mason last month took over the CBS Radio helm from Joel Hollander. At the time, he signaled an interest in bringing more digital applications and other technology to CBS Radio stations...

"'What we have created is a sophisticated advertising platform unlike any other technology being used by radio today,' Mason said. 'Advertising in the hollywood reporterstreaming media isn't like putting up a banner ad on a Web page ... the technology, among the purest forms of business to business advertising, is specifically designed for monetizing streaming audio and video.'"

"Charg(ing) us for promoting their product is egregious and short-sighted..."


My name is John Rhys-Eddins; owner and proprietor of BluePower.com, which has been broadcasting the Blues and R&B since 1994. When we started BluePower, I was the Blues Editor at Cash Box Magazine.

I have been in the music business since I was eighteen years old. I have produced a number of hit records and also worked as a record promotion man for Warner Brothers, Mercury Records, Roulette Records and many others. I can't believe that the consolidated major record companies are doing this to themselves. It makes no sense at all. In the old days, I was paid to take records to all the radio stations and told to get them played any way I could.

That they are trying to charge us for promoting their product is egregious and short-sighted.

I have written several lengthy letters to Senator Feinstein. She thinks that by keeping these awful rates the artists are going to be paid. I am an artist with many records to my credit and I have always had to litigate to collect even a small portion of my royalties. That's the game the majors always play. They won't pay unless they're forced to via court order....and then they're late.

Keep up the good fight my friend. We're all in this together.

"(We) do follow the law to the letter..."


Radio Scooter International is among the many small web broadcasters, that like so many others who use the services of Live 365 to stream broadcasts worldwide that do follow the law to the letter. All the music is purchased if not already on a CD from a legal download source.

And as a small personal broadcaster who makes no revenue from the love of music and broadcasting, but pays for the server usage, it literally confuses the entire staff how SoundExchange now is wanting to demand MORE money from those who do not make a cent off this venture.

Personally I welcome the Day of Silence, but fear SoundExchange could care less; for what my station and countless others do for the music industry, they should get on their collective knees and thank all of us for doing this and not wanting a thing in return.

"Oh, that's right, there isn't an 'elsewhere'..."


JazzPlayerRadio is in direct support of the "Day of Silence". We are however taking the next step and pulling the plug on our station April 30th. If things sort themselves out favorably, we will be back re-tooled and ready to provide our listeners with the best trumpet jazz available on the planet.

If a favorable business atmosphere fails to be created, our listeners will just have to get their trumpet "fix" elsewhere. Oh that's right, there isn't an elsewhere.

This sucks.

"(Large broadcasters)... have a lot to lose, too..."


I am prepared to shut both my stations down on May 8th, both Meander Comedy Radio, and Solace Radio (on Live365 and iTunes), however, I think it would be more effective if Live365 shut down the entire 10,000 stations at once.

I have sent bulletins on MySpace, a press release regarding the royalty rate situation on PRWeb, and am currently airing audio testimonials from fellow broadcasters regarding the crisis. I have also written to my legislators and newspaper and have much more to do, yet.

I hope you get Entercom, Clear Channel and others to participate,
because, especially with the burgeoning HD Radio, they have a lot to lose, too. The real losers in all of this are the artists.

"If the public can't hear the music, who will buy it?..."


Internet radio fills the void by creating niche programming no longer available on the commercial frequencies.

Our Internet station entitled "The Breez", provides easy listening music to a worldwide audience, something no longer available on commercial radio.

We have provided an outlet for all easy listening artists to have new life. Also, the opportunity to sell their product. We have become their "Internet shelf space".

If these new copyright rates go into affect, this station and most Internet stations will go silent.

If the public can't hear the music, who will buy it?

Nobody wins -- Everyone Loses!!
